Why is there a Prop 65 warning on my Proof product?
What is Proposition 65?
Proposition 65 is a California law that requires businesses to provide a warning if a product contains any of over 900 naturally occurring or synthetic chemicals, even in trace amounts. The goal is to inform consumers about potential exposure so they can make educated decisions.
Does this mean the product is unsafe?
Not necessarily. A Prop 65 warning does not mean a product is in violation of any safety standards. In fact, many common items like coffee, roasted vegetables, and balsamic vinegar carry this same warning because they contain naturally occurring substances on the list. We include this warning out of an abundance of caution to comply with California’s strict labeling laws, even if the compounds are below levels that would typically cause concern.
Which specific compounds triggered this warning?
The warning on Proof products typically refers to three compounds:
- THC (Delta-9-Tetrahydrocannabinol): Added to the Prop 65 list in 2020 for developmental toxicity. Even in our hemp products or CBD Only products, which are tested to be non-detectable for THC, California law does not provide a "safe harbor" (minimum) level for THC, meaning even the most microscopic trace requires a label.
- Myrcene (Beta-Myrcene): This is a naturally occurring terpene found in many plants, including mangoes, hops, and lemongrass. While it is harmless in normal amounts, it was added to the list based on studies involving extremely high doses.
- Marijuana Smoke: This is a standard part of the Prop 65 cannabis/hemp warning. Although our products are non-inhalable (e.g., tinctures, topicals, capsules) and do not involve smoking, the law often requires this broad language for all products derived from the cannabis plant.
